  • ## GENERAL TERMS AND CONDITIONS OF SALE

     

    ### 757 Design

     

    ### 1. Scope of application

     

    These General Terms and Conditions of Sale (hereinafter “GTC”) govern all contractual relationships between 757 Design, hereinafter referred to as “the Service Provider”, and its clients, whether professionals or private individuals, hereinafter referred to as “the Client”.

     

    Any order implies full and unconditional acceptance of these GTC, to the exclusion of any other conditions.

    ### 2. Services

     

    757 Design provides creative services, including in particular:

     

    * graphic design,

    * visual identity and branding,

    * printed and digital communication materials,

    * art direction.

     

    The exact scope of the services is detailed in the quotation accepted by the Client.

    ### 3. Quotation and order

     

    Services are subject to a written quotation, valid for 30 days from the date of issue.

     

    The order is considered final after:

     

    * written approval of the quotation (signature or agreement by email),

    * payment of any required deposit.

    ### 4. Prices

     

    Prices are expressed in euros (€), excluding VAT.

     

    VAT is applied in accordance with Belgian legislation in force.

     

    Prices indicated in the quotation are fixed for the duration of its validity.

     

    Any additional service not included will be subject to a supplementary quotation.

    ### 5. Payment terms

     

    Unless otherwise stated in the quotation:

     

    100 percent is required upon order,

     

    Invoices are payable within 14 calendar days from the date of issue, by bank transfer or any other method accepted by the Service Provider.

    ### 6. Late payment

     

    In the event of non-payment by the due date:

     

    * late payment interest will be due automatically, calculated at the applicable Belgian legal rate,

    * a fixed compensation of €250 will be due for recovery costs (professional clients).

     

    757 Design reserves the right to suspend any ongoing service until full payment is received.

    ### 7. Delivery times

     

    Delivery times are provided for information purposes only.

     

    The Service Provider cannot be held liable for delays resulting from:

     

    * lack of cooperation or validation by the Client,

    * repeated modifications,

    * force majeure.

    ### 8. Client obligations

     

    The Client undertakes to:

     

    * provide accurate and complete information,

    * hold all necessary rights to the materials provided,

    * actively collaborate in the proper execution of the assignment.

     

    757 Design declines all responsibility for errors resulting from incorrect information provided by the Client.

    ### 9. Intellectual property

     

    The creations produced remain the exclusive property of 757 Design until full payment of all sums due.

     

    Unless otherwise stated in the quotation, the transfer of exploitation rights is limited to:

     

    * the medium,

    * the territory,

    * the duration,

    * the use defined in the quotation.

     

    Any use not provided for will give rise to additional invoicing.

    ### 10. Right of publicity

     

    Unless expressly opposed in writing by the Client, 757 Design reserves the right to mention the Client’s name and to present the work carried out for communication, promotional and portfolio purposes.

    ### 11. Termination and cancellation

     

    In the event of cancellation of the order by the Client:

     

    * the deposit paid remains the property of the Service Provider,

    * services already performed are payable in proportion to the work completed.

    ### 12. Liability

     

    The liability of 757 Design is strictly limited to the amount of the invoiced service.

     

    The Service Provider cannot be held liable for indirect damages.

    ### 13. Confidentiality

     

    The parties undertake to keep strictly confidential all information exchanged in the context of the services.

    ### 14. Applicable law and jurisdiction

     

    These GTC are governed by Belgian law.

     

    Any dispute falls under the exclusive jurisdiction of the courts of the judicial district of the registered office of 757 Design.
